ISigaba 6(4) soMthetho Wezobulungiswa Emsebenzini uNombolo 55 wezi-1998 (EEA) sithi “Ukwehlukanisa okusobala nokufihliwe, emibandeleni yokuqashwa kwabasebenzi abenza umsebenzi owodwa ofanayo noma wenani elilinganayo, ngenxa yezizathu ezibaliwe nezingabaliwe ngumthetho; kungukubandlulula okungenabulungiswa. Ilungelo lokungabandlululwa emiholweni ngelawo wonke umuntu ongumqashwa futhi livikelwe ngumthetho. Kodwa inkinga enkulu kubasebenzi ukuveza ubufakazi bokubandlululwa emholweni. Phela umthetho uthi wena onesikhalo nguwe onomthwalo wokuveza ubufakazi balokho okhala ngakho.

Isenzo Sokuphatha Okungenabulungiswa Ebudlelwaneni Bokuqashwa

Ukuphathwa Okungenabulungiswa Okumayelana Nokukhuphulela Noma Ukuqasha Emsebenzini Othe Xaxa
INkantolo Yezabasebenzi seyakuchaza ukuthi ezinye izimpawu okumele mazibhekwe ukuze kuqinisekiswe ukuthi wudaba lokukhushulwa esikhuluma ngalo yilokhu okulandelayo. Umehluko phakathi kwezikhundla zomsebenzi okukhulunywa ngazo uma sibheka imiholo, imihlomulo, isithunzi (ukubaluleka) somsebenzi, izinga lemisebenzi yesikhundla ngasinye, amandla esikhundla ngasinye, kanye nokuphepha noma ukunethezeka kwesikhundla somsebenzi. Ukukhuphula izinga nenani lomsebenzi kodwa ingakhushulwa imali yomholo akumsizanga umqashi. Kwelinye icala inkantolo yanquma ukuthi ukukhuphula umsebenzi ngokwezinga, nenani kodwa kushiywe umholo, akusikhona ukukhuphula umqashwa esikhundleni.
Ukwehlisa Esikhundleni Somsebenzi Okuyisenzo Esingenabulungiswa
Umthetho Wezobudlelwano Emsebenzini iSigaba 186(2)(a) uchaza ukuphatha okungenabulungiswa ebudlelwaneni bokuqashwa ngokuthi “Yisenzo noma ukwehluleka ukwenza, okungenabulungiswa phakathi komqashi nomsebenzi okuphathelene nokwehliswa esikhundleni somsebenzi”.Ukwehliswa, emsebenzini wakho kungaba ukwehliswa komholo, ukunciphiswa kwemisebenzi, amandla noma isithunzi somsebenzi owenzayo. Kungabangelwa futhi ukugudlulwa noma ukushintshwa emsebenzini noma esikhundleni somsebenzi. Ngakho-ke ukugudlula kancane indlela okusetshenzwa ngayo kakusho ukwehliswa, ikakhulu uma lokho kungenamehluko otheni emsebenzini owenzayo.
Imihlomulo Nezenzo Zokuphatha Okungenabulungiswa Emsebenzini
